    1                        A bill to be entitled                      
    2         An act relating to community association pools;
    3         amending s. 514.0115, F.S.; exempting certain
    4         homeowners’ association pools from supervision by the
    5         Department of Health; providing exceptions; amending
    6         s. 553.77, F.S.; conforming a cross-reference;
    7         providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Present subsections (3) through (8) of section
   12  514.0115, Florida Statutes, are redesignated as subsections (4)
   13  through (9), respectively, and a new subsection (3) is added to
   14  that section, to read:
   15         514.0115 Exemptions from supervision or regulation;
   16  variances.—
   17         (3) Pools serving homeowners’ associations and other
   18  property associations that have no more than 32 units or parcels
   19  and are not operated as public lodging establishments are exempt
   20  from supervision under this chapter, except for supervision
   21  necessary to ensure water quality and under ss. 514.0315,
   22  514.05, and 514.06.
   23         Section 2. Subsection (7) of section 553.77, Florida
   24  Statutes, is amended to read:
   25         553.77 Specific powers of the commission.—
   26         (7) Building officials shall recognize and enforce variance
   27  orders issued by the Department of Health under s. 514.0115(9)
   28  pursuant to s. 514.0115(8), including any conditions attached to
   29  the granting of the variance.
   30         Section 3. This act shall take effect July 1, 2021.
