    1                        A bill to be entitled                      
    2         An act relating to the statute of limitations for
    3         sexual offenses; amending s. 95.11, F.S.; eliminating
    4         the statute of limitations period for civil actions
    5         for certain sexual offenses; providing applicability;
    6         providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (9) of section 95.11, Florida
   11  Statutes, is amended to read:
   12         95.11 Limitations other than for the recovery of real
   13  property.—Actions other than for recovery of real property shall
   14  be commenced as follows:
   15         (9) SEXUAL BATTERY OFFENSES ON VICTIMS UNDER AGE 16.—
   16         (a) An action related to an act constituting a violation of
   17  s. 794.011 involving a victim who was younger than under the age
   18  of 16 at the time of the act may be commenced at any time. This
   19  paragraph subsection applies to any such action other than one
   20  which would have been time barred on or before July 1, 2010.
   21         (b)Except as provided in paragraph (a), an action related
   22  to an act constituting a violation of s. 365.16, s. 365.161, s.
   23  794.011, s. 798.02, s. 800.02, s. 800.03, s. 800.09, s. 800.101,
   24  s. 825.1025, s. 827.071, s. 847.0135, s. 847.0141, s. 847.0147,
   25  s. 847.201, s. 847.002, s. 847.011, s. 847.012, s. 847.013, s.
   26  847.06, or s. 847.07 may be commenced at any time. This
   27  paragraph applies to any such action based on an act
   28  constituting such a violation taking place on or after January
   29  1, 2018, and to an action based on an act constituting such a
   30  violation for which the statute of limitations that was in
   31  effect before January 1, 2018, had not run as of January 1,
   32  2018.
   33         Section 2. This act shall take effect upon becoming a law.
