    1                        A bill to be entitled                      
    2         An act relating to residential swimming pools;
    3         providing a short title; amending s. 468.8323, F.S.;
    4         requiring a home inspector to specify in his or her
    5         written report whether a swimming pool meets certain
    6         requirements; amending s. 515.29, F.S.; requiring that
    7         a pool barrier be used at certain times at a residence
    8         where a young child resides; amending s. 515.33, F.S.;
    9         requiring a property owner who owns a parcel with a
   10         swimming pool to provide a person purchasing the
   11         parcel with specified information relating to pool
   12         safety; requiring the purchaser to acknowledge the
   13         receipt of such information in writing; providing an
   14         effective date.
   15          
   16  Be It Enacted by the Legislature of the State of Florida:
   17  
   18         Section 1. This act may be cited as the “Sylas Alexander
   19  Gatlyn Act”.
   20         Section 2. Paragraph (d) is added to subsection (1) of
   21  section 468.8323, Florida Statutes, to read:
   22         468.8323 Home inspection report.—Upon completion of each
   23  home inspection for compensation, the home inspector shall
   24  provide a written report prepared for the client.
   25         (1) The home inspector shall report:
   26         (d) If there is a swimming pool, as defined in s. 515.25,
   27  whether the swimming pool meets at least one of the requirements
   28  under s. 515.27(1).
   29         Section 3. Subsection (6) is added to section 515.29,
   30  Florida Statutes, to read:
   31         515.29 Residential swimming pool barrier requirements.—
   32         (6) A swimming pool at a residence that has a young child
   33  residing at the residence must have a barrier in place any time
   34  the pool is not being used or cleaned.
   35         Section 4. Section 515.33, Florida Statutes, is amended to
   36  read:
   37         515.33 Information required to be furnished to buyers.— 
   38         (1) A licensed pool contractor, on entering into an
   39  agreement with a buyer to build a residential swimming pool, or
   40  a licensed home builder or developer, on entering into an
   41  agreement with a buyer to build a house that includes a
   42  residential swimming pool, must give the buyer a document
   43  containing the requirements of this chapter and a copy of the
   44  publication produced by the department under s. 515.31 that
   45  provides information on drowning prevention and the
   46  responsibilities of pool ownership.
   47         (2)A property owner who owns a parcel that includes a
   48  swimming pool, on entering into an agreement with a buyer for
   49  the purchase of such parcel, must give the buyer a document
   50  containing the requirements of this chapter and a copy of the
   51  publication produced by the department under s. 515.31 that
   52  provides information on drowning prevention and the
   53  responsibilities of pool ownership. The buyer must acknowledge,
   54  in writing, that he or she received such documents.
   55         Section 5. This act shall take effect July 1, 2021.
