       The Committee on Appropriations (Gainer) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsection (4) of section 1009.22, Florida
    6  Statutes, is amended to read:
    7         1009.22 Workforce education postsecondary student fees.—
    8         (4)(a) A district school board or Florida College System
    9  institution board of trustees that has a service area that
   10  borders another state may implement a plan for a differential
   11  out-of-state fee.
   12         (b)A district school board or Florida College System
   13  institution board of trustees, in consultation with regional
   14  workforce and economic development organizations, may implement
   15  a plan for a differential out-of-state fee for the purpose of
   16  recruiting students into programs of study identified as
   17  necessary to address unmet current and future workforce needs in
   18  the region as identified by the Labor Market Estimating
   19  Conference created in s. 216.136 or the Credentials Review
   20  Committee established in s. 445.004. A school district or
   21  Florida College System institution shall prioritize the
   22  enrollment of a resident student in the identified programs of
   23  study over an out-of-state student. A district school board or
   24  Florida College System institution board of trustees shall
   25  annually provide a report to the State Board of Education on the
   26  employment outcomes of the students who receive a differential
   27  out-of-state fee. The report must include the percentage of such
   28  students who are employed in the occupations identified as
   29  having unmet current and future workforce needs.
   30         Section 2. Present paragraph (b) of subsection (6) of
   31  section 1009.23, Florida Statutes, is redesignated as paragraph
   32  (c), and a new paragraph (b) is added to that subsection, to
   33  read:
   34         1009.23 Florida College System institution student fees.—
   35         (6)
   36         (b)A Florida College System institution board of trustees,
   37  in consultation with regional workforce and economic development
   38  organizations, may implement a plan for a differential out-of
   39  state fee for the purpose of recruiting students into programs
   40  of study identified as necessary to address unmet current and
   41  future workforce needs in the region as identified by the Labor
   42  Market Estimating Conference created in s. 216.136 or the
   43  Credentials Review Committee established in s. 445.004. A
   44  Florida College System institution shall prioritize the
   45  enrollment of a resident student in the identified programs of
   46  study over an out-of-state student. A Florida College System
   47  institution board of trustees shall annually provide a report to
   48  the State Board of Education on the employment outcomes of the
   49  students who receive a differential out-of-state fee. The report
   50  must include the percentage of such students who are employed in
   51  the occupations identified as having unmet current and future
   52  workforce needs.
   53         Section 3. This act shall take effect July 1, 2022.

   62         authorizing district school boards and Florida College
   63         System institutions’ boards of trustees, in
   64         consultation with certain organizations, to implement
   65         a plan for a differential out-of-state fee for
   66         specified purposes; requiring school districts and
   67         Florida College System institutions to prioritize the
   68         enrollment of certain students in specified programs
   69         of study; providing reporting requirements; providing
   70         an effective date.
