    1                        A bill to be entitled                      
    2         An act relating to driver history records; amending s.
    3         322.20, F.S.; prohibiting the Department of Highway
    4         Safety and Motor Vehicles from releasing driver
    5         history records to third parties which include certain
    6         notations or records; providing an effective date.
    7          
    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (3) of section 322.20, Florida
   11  Statutes, is amended to read:
   12         322.20 Records of the department; fees; destruction of
   13  records.—
   14         (3) The department shall maintain convenient records or
   15  make suitable notations, in order that the individual driver
   16  history record of each licensee is readily available for the
   17  consideration of the department upon application for renewal of
   18  a license and at other suitable times.
   19         (a) The release by the department of the driver history
   20  record, with respect to crashes involving a licensee, shall not
   21  include any notation or record of the occurrence of a motor
   22  vehicle crash unless the licensee received a traffic citation as
   23  a direct result of the crash, and to this extent such notation
   24  or record is exempt from the provisions of s. 119.07(1).
   25         (b) The release by the department of the driver history
   26  record to a third party shall not include any notation or record
   27  of a uniform traffic citation or an election made under s.
   28  318.14(9) for the citation if, pursuant to the department’s
   29  records retention schedule, the citation would otherwise have
   30  been excluded from the driver history record if the election
   31  under s. 318.14(9) was not made.
   32         Section 2. This act shall take effect July 1, 2022.
