Florida Senate - 2022 SB 1224 By Senator Wright 14-00794-22 20221224__ 1 A bill to be entitled 2 An act relating to commercial vehicle insurance; 3 amending s. 507.04, F.S.; revising liability insurance 4 requirements for movers’ commercial motor vehicles; 5 amending s. 627.7415, F.S.; revising additional 6 liability insurance requirements for commercial motor 7 vehicles; providing an exception for wreckers; 8 providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Paragraph (c) of subsection (2) of section 13 507.04, Florida Statutes, is amended to read: 14 507.04 Required insurance coverages; liability limitations; 15 valuation coverage.— 16 (2) MOTOR VEHICLE INSURANCE.—Each mover operating in this 17 state must maintain current and valid motor vehicle insurance 18 coverage, including combined bodily injury and property damage 19 liability coverage in the following minimum amounts: 20 (c) Seven hundred and fifty thousandThree hundred thousand21 dollars per occurrence for a commercial motor vehicle with a 22 gross weight of 44,000 pounds or more. 23 Section 2. Subsection (3) of section 627.7415, Florida 24 Statutes, is amended to read: 25 627.7415 Commercial motor vehicles; additional liability 26 insurance coverage.—Commercial motor vehicles, as defined in s. 27 207.002 or s. 320.01, operated upon the roads and highways of 28 this state shall be insured with the following minimum levels of 29 combined bodily liability insurance and property damage 30 liability insurance in addition to any other insurance 31 requirements: 32 (3) Seven hundred and fifty thousandThree hundred thousand33 dollars per occurrence for a commercial motor vehicle with a 34 gross vehicle weight of 44,000 pounds or more, except for a 35 vehicle that is a wrecker as defined in s. 320.01(39) and is 36 eligible for a license plate under s. 320.0821, which wrecker 37 must be insured at $300,000 per occurrence. 38 39 A violation of this section is a noncriminal traffic infraction, 40 punishable as a nonmoving violation as provided in chapter 318. 41 Section 3. This act shall take effect January 1, 2023.
