Florida Senate - 2022 SCR 1242 By Senator Gibson 6-00143-22 20221242__ 1 Senate Concurrent Resolution 2 A concurrent resolution ratifying the proposed 3 amendment to the Constitution of the United States 4 relating to equal rights for men and women. 5 6 WHEREAS, during the Second Session of the 92nd Congress of 7 the United States of America, by a constitutional majority of 8 two-thirds, both houses of Congress approved the Equal Rights 9 Amendment, and 10 WHEREAS, on March 22, 1972, this proposed amendment to the 11 Constitution of the United States was sent to the states for 12 ratification, and 13 WHEREAS, Article V of the United States Constitution 14 authorizes the Florida Legislature to ratify proposed amendments 15 to the Constitution of the United States, and 16 WHEREAS, the provisions of the 1972 Equal Rights Amendment 17 contained a 7-year period for ratification, a deadline the 18 United States Congress later extended to 1982 after 35 states 19 had ratified the amendment, and 20 WHEREAS, measures have been introduced in the United States 21 House of Representatives and the United States Senate to 22 eliminate the ratification deadline from the amendment, and 23 WHEREAS, constitutional equality for men and women 24 continues to be timely in the United States and worldwide, and 25 many other nations have achieved constitutional equality for men 26 and women, NOW, THEREFORE, 27 28 Be It Resolved by the Senate of the State of Florida, the House 29 of Representatives Concurring: 30 31 That the proposed amendment to the Constitution of the 32 United States set forth below is ratified by the Legislature of 33 the State of Florida. 34 “ARTICLE ____ 35 “SECTION 1. Equality of rights under the law shall not be 36 denied or abridged by the United States or by any State on 37 account of sex. 38 “SECTION 2. The Congress shall have the power to enforce, 39 by appropriate legislation, the provisions of this article. 40 “SECTION 3. This amendment shall take effect two years 41 after the date of ratification.” 42 BE IT FURTHER RESOLVED that certified copies of the 43 foregoing preamble and resolution be immediately forwarded by 44 the Secretary of State of the State of Florida, under the Great 45 Seal of this state, to the President of the United States, the 46 Secretary of State of the United States, the President of the 47 Senate of the United States, the Speaker of the House of 48 Representatives of the United States, and the Administrator of 49 the General Services Administration of the United States.
