Senator Brandes moved the following:

5 insert:
6 Section 1. Subsection (14) is added to section 70.001,
7 Florida Statutes, to read:
8 70.001 Private property rights protection.—
9 (14) Notwithstanding subsection (12), before designating
10 real property as a historic resource, historic landmark, or part
11 of a historic district, or placing real property under a similar
12 designation, a local government must read a statement in a
13 public meeting outlining each affected property owner’s rights
14 under the Bert J. Harris, Jr., Private Property Rights
15 Protection Act and provide a copy of such statement to each
16 affected property owner or registered agent by certified mail at
17 least 30 days before the local government makes such
18 designation. The statement must include, but is not limited to,
19 notice to the property owner that:
20 (a) The proposed law or regulation may impact the property
21 owner’s existing property rights;
22 (b) The Bert J. Harris, Jr., Private Property Rights
23 Protection Act provides relief for property owners whose
24 property rights have been burdened by the actions of a local
25 government;
26 (c) Such relief may include compensation for the actual
27 loss to the fair market value of the real property caused by
28 such action; and
29 (d) The property owner may have only 1 year after a law or
30 regulation is first applied to the property at issue to pursue
31 any rights established under the Bert J. Harris, Jr., Private
32 Property Rights Protection Act.

35 And the title is amended as follows:

37 insert:
38 70.001, F.S.; requiring local governments to read a
39 certain statement in a public meeting and provide
40 property owners with a copy of the statement before
41 making certain designations of real property;
42 providing requirements for such statement; amending s.
