       The Committee on Appropriations (Brodeur) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 573 - 636
    4  and insert:
    5  regional or statewide basis. The agency shall procure:
    6         (a) At least 3 plans and up to 4 plans for Region A.
    7         (b) At least 3 plans and up to 6 plans for Region B.
    8         (c) At least 3 plans and up to 5 plans for Region C.
    9         (d) At least 4 plans and up to 7 plans for Region D.
   10         (e) At least 3 plans and up to 6 plans for Region E.
   11         (f) At least 3 plans and up to 4 plans for Region F.
   12         (g) At least 3 plans and up to 5 plans for Region G.
   13         (h) At least 3 plans and up to 5 plans for Region H.
   14         (i) At least 5 plans and up to 10 plans for Region I. The
   15  agency shall notice invitations to negotiate no later than
   16  January 1, 2013.
   17         (a) The agency shall procure two plans for Region 1. At
   18  least one plan shall be a provider service network if any
   19  provider service networks submit a responsive bid.
   20         (b) The agency shall procure two plans for Region 2. At
   21  least one plan shall be a provider service network if any
   22  provider service networks submit a responsive bid.
   23         (c) The agency shall procure at least three plans and up to
   24  five plans for Region 3. At least one plan must be a provider
   25  service network if any provider service networks submit a
   26  responsive bid.
   27         (d) The agency shall procure at least three plans and up to
   28  five plans for Region 4. At least one plan must be a provider
   29  service network if any provider service networks submit a
   30  responsive bid.
   31         (e) The agency shall procure at least two plans and up to
   32  four plans for Region 5. At least one plan must be a provider
   33  service network if any provider service networks submit a
   34  responsive bid.
   35         (f) The agency shall procure at least four plans and up to
   36  seven plans for Region 6. At least one plan must be a provider
   37  service network if any provider service networks submit a
   38  responsive bid.
   39         (g) The agency shall procure at least three plans and up to
   40  six plans for Region 7. At least one plan must be a provider
   41  service network if any provider service networks submit a
   42  responsive bid.
   43         (h) The agency shall procure at least two plans and up to
   44  four plans for Region 8. At least one plan must be a provider
   45  service network if any provider service networks submit a
   46  responsive bid.
   47         (i) The agency shall procure at least two plans and up to
   48  four plans for Region 9. At least one plan must be a provider
   49  service network if any provider service networks submit a
   50  responsive bid.
   51         (j) The agency shall procure at least two plans and up to
   52  four plans for Region 10. At least one plan must be a provider
   53  service network if any provider service networks submit a
   54  responsive bid.
   55         (k) The agency shall procure at least five plans and up to
   56  10 plans for Region 11. At least one plan must be a provider
   57  service network if any provider service networks submit a
   58  responsive bid.

   60  If no provider service network submits a responsive bid, the
   61  agency shall procure no more than one less than the maximum
   62  number of eligible plans permitted in that region. Within 12
   63  months after the initial invitation to negotiate, the agency
   64  shall attempt to procure a provider service network. The agency
   65  shall notice another invitation to negotiate only with provider
   66  service networks in those regions where no provider service
   67  network has been selected.
