       The Committee on Environment and Natural Resources (Gruters)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 27 - 42
    4  and insert:
    5  supersedes any county or municipal municipal or county ordinance
    6  on the subject; however, counties and municipalities may further
    7  restrict smoking within the boundaries of any public beaches or
    8  public parks that they own, except with regard to the smoking of
    9  cigars that do not contain a filter or a plastic tip or the
   10  smoking of pipe tobacco in a pipe. Municipalities may further
   11  restrict smoking within the boundaries of any public beaches or
   12  public parks that are within their jurisdiction but are owned by
   13  the county if doing so would not conflict with a county
   14  ordinance, except that they may not further restrict the smoking
   15  of cigars that do not contain a filter or plastic tip or the
   16  smoking of pipe tobacco in a pipe. School districts may further
   17  restrict smoking by persons on school district property. This
   18  section does not preclude the adoption of county or municipal
   19  municipal or county ordinances that impose more restrictive
   20  regulation on the use of vapor-generating devices than is
   21  provided in this part.
