Florida Senate - 2022 SB 2506 By the Committee on Appropriations 576-02875-22 20222506__ 1 A bill to be entitled 2 An act relating to ratification of Department of 3 Management Services rules; ratifying specified rules 4 relating to health maintenance organization plan 5 regions established by department rule for the sole 6 and exclusive purpose of satisfying any condition on 7 effectiveness pursuant to s. 110.123(3)(h)2.d., F.S., 8 which requires ratification of the rules in order for 9 them to take effect; providing applicability; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. (1) The following rules are ratified for the 15 sole and exclusive purpose of satisfying any condition on 16 effectiveness imposed under s. 110.123(3)(h)2.d., Florida 17 Statutes: Rules 60P-1.003, 60P-2.002, and 60P-2.003, Florida 18 Administrative Code, titled “Definitions,” “Eligibility and 19 Enrollment,” and “Changes in Coverage,” respectively, as filed 20 for adoption with the Department of State pursuant to the 21 certification packages dated October 1, 2019, and November 4, 22 2021. 23 (2) This act may not be codified in the Florida Statutes. 24 After this act becomes law, its enactment and effective dates 25 shall be noted in the Florida Administrative Code or the Florida 26 Administrative Register, or both, as appropriate. This act does 27 not alter rulemaking authority delegated by prior law; provided 28 any amendment to a rule ratified pursuant to this act which 29 would modify the designated geographical areas for use in 30 procurements of Health Maintenance Organization services before 31 January 1, 2024, would require ratification by the Legislature 32 before taking effect. This act does not constitute legislative 33 preemption of or exception to any provision of law governing 34 adoption or enforcement of the rules cited, and is intended to 35 preserve the status of any cited rule as a rule under chapter 36 120, Florida Statutes. This act does not cure any rulemaking 37 defect or preempt any challenge based on lack of authority or a 38 violation of the legal requirements governing the adoption of 39 any rule cited. 40 Section 2. This act shall take effect upon becoming a law.
