       The Committee on Children, Families, and Elder Affairs (Perry)
       recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 27 - 32
    4  and insert:
    5         (2)(a) Except as provided in paragraph (b), a person who
    6  violates subsection (1) commits a misdemeanor of the first
    7  degree, punishable as provided in s. 775.082 or s. 775.083.
    8         (b) A person who has one prior conviction for lewd and
    9  lascivious molestation committed upon persons 16 years of age or
   10  older and who commits any second or subsequent violation of
   11  subsection (1) commits a felony of the third degree, punishable
   12  as provided in s. 775.082, s. 775.083, or s. 775.084.
