1 A bill to be entitled
2 An act relating to the value of motor vehicles exempt
3 from legal process; amending s. 222.25, F.S.;
4 authorizing certain natural persons to exempt a
5 specified amount of interest in a single motor vehicle
6 from certain legal processes; providing applicability;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 222.25, Florida Statutes, is amended to
12 read:
13 222.25 Other individual property of natural persons exempt
14 from legal process.—
15 (1) The following property is exempt from attachment,
16 garnishment, or other legal process:
17 (a)(1) A debtor’s interest, not to exceed $1,000 in value,
18 in a single motor vehicle as defined in s. 320.01(1) s. 320.01.
19 (b)(2) A debtor’s interest in any professionally prescribed
20 health aids for the debtor or a dependent of the debtor.
21 (c)(3) A debtor’s interest in a refund or a credit received
22 or to be received, or the traceable deposits in a financial
23 institution of a debtor’s interest in a refund or credit,
24 pursuant to s. 32 of the Internal Revenue Code of 1986, as
25 amended. This exemption does not apply to a debt owed for child
26 support or spousal support.
27 (d)(4) A debtor’s interest in personal property, not to
28 exceed $4,000, if the debtor does not claim or receive the
29 benefits of a homestead exemption under s. 4, Art. X of the
30 State Constitution. This exemption does not apply to a debt owed
31 for child support or spousal support.
32 (2) Notwithstanding paragraph (1)(a), an individual debtor
33 under the federal Bankruptcy Code may exempt a debtor’s
34 interest, not to exceed $5,000 in value, in a single motor
35 vehicle as defined in s. 320.01(1). This subsection applies to
36 any bankruptcy action filed on or after July 1, 2022.
37 Section 2. This act shall take effect July 1, 2022.
