Florida Senate - 2022 CS for SB 538 By the Committee on Rules; and Senator Hooper 595-03654-22 2022538c1 1 A bill to be entitled 2 An act relating to private instructional personnel 3 providing applied behavior analysis services; amending 4 s. 1003.572, F.S.; revising the definition of the term 5 “private instructional personnel” to include certain 6 registered behavior technicians; requiring a 7 registered behavior technician to meet specified 8 requirements to provide services; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Present paragraphs (b) through (f) of subsection 14 (1) of section 1003.572, Florida Statutes, are redesignated as 15 paragraphs (c) through (g), respectively, and a new paragraph 16 (b) is added to that subsection, to read: 17 1003.572 Collaboration of public and private instructional 18 personnel.— 19 (1) As used in this section, the term “private 20 instructional personnel” means: 21 (b) Registered behavior technicians who have a nationally 22 recognized paraprofessional certification in behavior analysis 23 and who practice under the supervision of individuals described 24 in paragraph (a) by assisting and supporting such individuals in 25 the provision of applied behavior analysis services. To provide 26 services under this section, the registered behavior technician 27 must be employed by an enrolled Medicaid provider. 28 Section 2. This act shall take effect July 1, 2022.
