       The Committee on Appropriations (Rodriguez) recommended the
       following:
       
    1         Senate Amendment (with title amendment)

    3         Delete lines 140 - 155
    4  and insert:
    5         Section 3. Present paragraphs (d) through (o) of subsection
    6  (1) and present paragraphs (e) through (h) of subsection (14) of
    7  section 381.986, Florida Statutes, are redesignated as
    8  paragraphs (e) through (p) of subsection (1) and paragraphs (f)
    9  through (i) of subsection (14), respectively, a new paragraph
   10  (d) is added to subsection (1) and a new paragraph (e) is added
   11  to subsection (14), and paragraphs (a) and (c) of subsection (3)
   12  and paragraph (e) of subsection (8) of that section are amended,
   13  to read:
   14         381.986 Medical use of marijuana.—
   15         (1) DEFINITIONS.—As used in this section, the term:
   16         (d)“Dispense” means the act of selling, delivering, or
   17  otherwise transferring marijuana or a marijuana delivery device
   18  to a patient or caregiver.
   19         (3) QUALIFIED PHYSICIANS AND MEDICAL DIRECTORS.—
   20         (a) Before being approved as a qualified physician, as
   21  defined in paragraph (1)(m), and before each license renewal, a
   22  physician must successfully complete a 2-hour course and
   23  subsequent examination offered by the Florida Medical
   24  Association or the Florida Osteopathic Medical Association which
   25  encompass the requirements of this section and any rules adopted
   26  hereunder. The course and examination shall be administered at
   27  least annually and may be offered in a distance learning format,
   28  including an electronic, online format that is available upon
   29  request. The price of the course may not exceed $500. A
   30  physician who has met the physician education requirements of
   31  former s. 381.986(4), Florida Statutes 2016, before June 23,
   32  2017, shall be deemed to be in compliance with this paragraph
   33  from June 23, 2017, until 90 days after the course and
   34  examination required by this paragraph become available.
   35         (c) Before being employed as a medical director, as defined
   36  in paragraph (1)(i), and before each license renewal, a medical
   37  director must successfully complete a 2-hour course and
   38  subsequent examination offered by the Florida Medical
   39  Association or the Florida Osteopathic Medical Association which
   40  encompass the requirements of this section and any rules adopted
   41  hereunder. The course and examination shall be administered at
   42  least annually and may be offered in a distance learning format,
   43  including an electronic, online format that is available upon
   44  request. The price of the course may not exceed $500.
   45         (8) MEDICAL MARIJUANA TREATMENT CENTERS.—
   46         (e) A licensed medical marijuana treatment center shall
   47  cultivate, process, transport, and dispense marijuana for
   48  medical use. A licensed medical marijuana treatment center may
   49  not contract for services directly related to the cultivation,
   50  processing, and dispensing of marijuana or marijuana delivery
   51  devices, except that a medical marijuana treatment center
   52  licensed pursuant to subparagraph (a)1. may contract with a
   53  single entity for the cultivation, processing, transporting, and
   54  dispensing of marijuana and marijuana delivery devices and may
   55  contract for services to assist the licensed medical marijuana
   56  treatment center with receiving and managing orders for
   57  marijuana or marijuana delivery devices so long as the actual
   58  dispensing is completed by the licensed medical marijuana
