       The Committee on Community Affairs (Farmer) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsection (12) of section 83.43, Florida
    6  Statutes, is amended to read:
    7         83.43 Definitions.—As used in this part, the following
    8  words and terms shall have the following meanings unless some
    9  other meaning is plainly indicated:
   10         (12) “Security deposits” means any moneys equal to or less
   11  than the value of 1 month’s rent if provided at the time of
   12  execution of the rental agreement or equal to or less than 8.75
   13  percent of the value of 1 month’s rent if deposited on a monthly
   14  basis for a period not exceeding 12 months and which are held by
   15  the landlord as security for the performance of the rental
   16  agreement, including, but not limited to, monetary damage to the
   17  landlord caused by the tenant’s breach of lease prior to the
   18  expiration thereof.
   19         Section 2. This act shall take effect July 1, 2022.

   23         Delete everything before the enacting clause
   24  and insert:
   25                        A bill to be entitled                      
   26         An act relating to security deposits for residential
   27         tenancies; amending s. 83.43, F.S.; revising the
   28         definition of the term “security deposits”; providing
   29         an effective date.
