The Committee on Transportation (Bradley) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 21 - 37
4 and insert:
5 commercial, or industrial use. Provided the parcel is zoned for
6 commercial or industrial use, an approval may include any
7 residential development project, including a mixed-use
8 residential development project, if a portion of the project is
9 for housing that is affordable and the sponsor of the project
10 agrees not to apply for or receive funding under s. 420.5087.
11 The provisions of this subsection are self-executing and do not
12 require the board of county commissioners to adopt an ordinance
13 or a regulation before using the approval process in this
14 subsection.
15 Section 2. Subsection (6) of section 166.04151, Florida
16 Statutes, is amended to read:
17 166.04151 Affordable housing.—
18 (6) Notwithstanding any other law or local ordinance or
19 regulation to the contrary, the governing body of a municipality
20 may approve the development of housing that is affordable, as
21 defined in s. 420.0004, on any parcel zoned for residential,
22 commercial, or industrial use. Provided the parcel is zoned for
23 commercial or industrial use, an approval may include any
24 residential development project, including a mixed-use
25 residential development project, if a portion of the project

28 And the title is amended as follows:
29 Delete lines 2 - 9
30 and insert:
31 An act relating to residential development projects
32 for affordable housing; amending ss. 125.01055 and
33 166.04151, F.S.; authorizing counties and
34 municipalities, respectively, to approve any
35 residential development project on parcels zoned for
36 commercial or industrial use if certain conditions are
37 met; providing construction;
