    1                        A bill to be entitled                      
    2         An act relating to the Beverage Law; amending s.
    3         561.14, F.S.; providing exemptions relating to the
    4         purchase of alcoholic beverages from manufacturers by
    5         vendors; amending s. 561.221, F.S.; authorizing
    6         certain manufacturers who possess a vendor’s license
    7         to sell, transport, or deliver alcoholic beverages to
    8         specified vendors under certain circumstances;
    9         providing applicability; amending s. 565.03, F.S.;
   10         authorizing craft distilleries to sell, transport, or
   11         deliver branded products to specified vendors under
   12         certain circumstances; providing an effective date.
   13          
   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Subsection (3) of section 561.14, Florida
   17  Statutes, is amended to read:
   18         561.14 License and registration classification.—Licenses
   19  and registrations referred to in the Beverage Law shall be
   20  classified as follows:
   21         (3) Vendors licensed to sell alcoholic beverages at retail
   22  only. No vendor shall purchase or acquire in any manner for the
   23  purpose of resale any alcoholic beverages from any person not
   24  licensed as a vendor, manufacturer, bottler, or distributor
   25  under the Beverage Law. Purchases of alcoholic beverages by
   26  vendors from vendors shall be strictly limited to purchases
   27  between members of a pool buying group for which the initial
   28  purchase of the alcoholic beverages was ordered by a pool buying
   29  agent as a single transaction; purchases from a manufacturer
   30  licensed as a vendor and authorized to sell, transport, or
   31  deliver alcoholic beverages to a vendor under s. 561.221; and
   32  purchases from a craft distillery authorized to sell, transport,
   33  or deliver branded products under s. 565.03(2)(g). No vendor
   34  shall be a member of more than one cooperative or pool buying
   35  group at any time. No vendor shall import, or engage in the
   36  importation of, any alcoholic beverages from places beyond the
   37  limits of the state.
   38         Section 2. Paragraph (d) of subsection (2) of section
   39  561.221, Florida Statutes, is amended, and paragraph (f) is
   40  added to that subsection, to read:
   41         561.221 Licensing of manufacturers and distributors as
   42  vendors and of vendors as manufacturers; conditions and
   43  limitations.—
   44         (2)
   45         (d) A manufacturer possessing a vendor’s license under this
   46  subsection is not permitted to make deliveries under s.
   47  561.57(1), except as provided in paragraph (f).
   48         (f) Notwithstanding any other provision of the Beverage
   49  Law, a manufacturer possessing a vendor’s license under this
   50  subsection may sell, transport, or deliver alcoholic beverages
   51  manufactured on its licensed premises to vendors within the same
   52  county where the manufacturer is located or within an adjacent
   53  county. A manufacturer making a delivery under this paragraph
   54  must comply with ss. 561.42 and 561.423, as applicable, to the
   55  same extent as if the manufacturer were a distributor.
   56         1.A delivery under this paragraph is subject to s.
   57  561.57(2).
   58         2.This paragraph does not apply to a manufacturer who
   59  produces more than 60,000 barrels of malt beverages a year.
   60         Section 3. Paragraph (g) is added to subsection (2) of
   61  section 565.03, Florida Statutes, to read:
   62         565.03 License fees; manufacturers, distributors, brokers,
   63  sales agents, and importers of alcoholic beverages; vendor
   64  licenses and fees; distilleries and craft distilleries.—
   65         (2)
   66         (g) Notwithstanding any other provision of the Beverage
   67  Law, a craft distillery may sell, transport, or deliver branded
   68  products to vendors within the same county where the craft
   69  distillery is located or within an adjacent county. A craft
   70  distillery making a delivery under this paragraph must comply
   71  with s. 561.42 to the same extent as if the craft distillery
   72  were a distributor. A delivery under this paragraph is subject
   73  to s. 561.57(2).
   74         Section 4. This act shall take effect July 1, 2022.
