Floor: 2/AD/2R . 05/24/2022 11:42 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Boyd moved the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 525 and 526 4 insert: 5 (4) The department may adopt emergency rules pursuant to s. 6 120.54, Florida Statutes, at any time, as are necessary to 7 implement this section and s. 215.5586, Florida Statutes, as 8 amended by this act. The Legislature finds that such emergency 9 rulemaking authority is necessary to address a critical need in 10 the state’s problematic property insurance market. The 11 Legislature further finds that the uniquely short timeframe 12 needed to effectively implement this section for the 2022-2023 13 fiscal year requires that the department adopt rules as quickly 14 as practicable. Therefore, in adopting such emergency rules, the 15 department need not make the findings required by s. 16 120.54(4)(a), Florida Statutes. Emergency rules adopted under 17 this section are exempt from s. 120.54(4)(c), Florida Statutes, 18 and shall remain in effect until replaced by rules adopted under 19 the nonemergency rulemaking procedures of chapter 120, Florida 20 Statutes, which must occur no later than July 1, 2023. 21 22 ================= T I T L E A M E N D M E N T ================ 23 And the title is amended as follows: 24 Delete line 58 25 and insert: 26 appropriation of any unexpended balance; authorizing 27 the Department of Financial Services to adopt 28 emergency rules; providing legislative findings; 29 providing that such rules remain in effect until 30 replaced by rules adopted using nonemergency 31 rulemaking procedures; providing for
