Senator Berman moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 236 - 251
4 and insert:
5 (a) Provide comprehensive, medically accurate, and factual
6 information that is developmentally and age appropriate. As used
7 in this paragraph, the term:
8 1. “Comprehensive information” means information that:
9 a. Helps young people gain knowledge about the physical,
10 biological, and hormonal changes of adolescence and subsequent
11 stages of human maturation;
12 b. Develops the knowledge and skills necessary to protect
13 young people with respect to their sexual and reproductive
14 health and to promote an understanding of sexuality as a normal
15 part of human development;
16 c. Helps young people gain knowledge about responsible
17 decisionmaking and consent;
18 d. Is culturally competent and appropriate for use with
19 young people of any race, sex, gender identity, sexual
20 orientation, or ethnic or cultural background;
21 e. Develops healthy attitudes and behaviors concerning
22 growth, development, and body image;
23 f. Encourages young people to practice healthy life skills,
24 including negotiation and refusal skills, to assist in
25 overcoming peer pressure and use effective decisionmaking skills
26 to avoid high-risk activities;
27 g. Promotes self-esteem and positive interpersonal skills,
28 focusing on skills needed to develop healthy relationships and
29 interactions, and provides young people with the knowledge and
30 skills necessary to have healthy, positive, and safe
31 relationships and behaviors; and
32 h. Includes medically accurate information about all
33 methods of contraception and each method’s effectiveness rate,
34 including, but not limited to, abstinence.
35 2. “Developmentally and age appropriate” means suitable for
36 particular ages or age groups of children and adolescents based
37 on the developing cognitive, emotional, and behavioral capacity
38 typical for that age or age group.
39 3. “Factual information” includes, but is not limited to,
40 medical, psychiatric, psychological, empirical, and statistical
41 statements.
42 4. “Medically accurate information” means information
43 relevant to informed decisionmaking which is based on scientific
44 evidence, consistent with generally recognized scientific
45 theory, identified under accepted scientific methods, published
46 in peer-reviewed journals, and recognized as accurate,
47 objective, and complete by mainstream professional
48 organizations, including, but not limited to, the American
49 Medical Association, the American College of Obstetricians and
50 Gynecologists, the American Public Health Association, and the
51 American Academy of Pediatrics; government agencies, including
52 the United States Centers for Disease Control and Prevention,
53 the United States Food and Drug Administration, and the National
54 Institutes of Health; and scientific advisory groups, including
55 The National Academy of Medicine and the Advisory Committee on
56 Immunization Practices. The deliberate withholding of
57 information that is needed to protect the life and health of an
58 individual is considered medically inaccurate.
59 (a) Teach abstinence from sexual activity outside of
60 marriage as the expected standard for all school-age students
61 while teaching the benefits of monogamous heterosexual marriage.
62 (b) Emphasize that abstinence from sexual activity is a
63 certain way to avoid out-of-wedlock pregnancy, sexually
64 transmitted diseases, including acquired immune deficiency
65 syndrome, and other associated health problems.
66 (b)(c) Teach that each student has the power to control
67 personal behavior and encourage students to base actions on
68 reasoning, self-esteem, and respect for others.
