    2         An act relating to term limits; creating s. 124.012,
    3         F.S.; establishing term limits for county
    4         commissioners; providing for construction; amending s.
    5         1001.35, F.S.; revising term limits for district
    6         school board members; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 124.012, Florida Statutes, is created to
   11  read:
   12         124.012 Term limits of county commissioners.—
   13         (1) A person may not appear on the ballot for reelection to
   14  the office of county commissioner if, by the end of his or her
   15  current term of office, the person will have served, or but for
   16  resignation would have served, in that office for 8 consecutive
   17  years. Service of a term of office which commenced before
   18  November 8, 2022, will not be counted toward the limitation
   19  imposed by this section in any county that has not adopted term
   20  limits as of July 1, 2023.
   21         (2) This section supersedes any term limits imposed by a
   22  county charter; however, this section may not be construed to
   23  extend term limits already applicable to a county commissioner
   24  as of July 1, 2023, under an applicable provision of a county
   25  charter adopted before July 1, 2023.
   26         Section 2. Section 1001.35, Florida Statutes, is amended to
   27  read:
   28         1001.35 Term of office.—District school board members shall
   29  be elected at the general election in November for terms of 4
   30  years, except that a person may not appear on the ballot for
   31  reelection to the office of school board member if, by the end
   32  of his or her current term of office, the person will have
   33  served, or but for resignation would have served, in that office
   34  for 8 12 consecutive years. Service of a term of office which
   35  commenced before November 8, 2022, will not be counted toward
   36  the limitation imposed by this section.
   37         Section 3. This act shall take effect July 1, 2023.
