    2         An act relating to term limits; creating s. 124.012,
    3         F.S.; establishing term limits for county
    4         commissioners; providing construction; amending s.
    5         1001.35, F.S.; revising term limits for district
    6         school board members; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 124.012, Florida Statutes, is created to
   11  read:
   12         124.012 Term limits of county commissioners.—
   13         (1) Notwithstanding the terms of any county charter to the
   14  contrary, a person may not appear on the ballot for reelection
   15  to the office of county commissioner if, by the end of his or
   16  her current term of office, the person will have served, or but
   17  for resignation would have served, in that office for 8
   18  consecutive years. In any county in which term limits are not
   19  imposed by county charter as of the effective date of this act,
   20  service of a term of office which commenced before November 8,
   21  2022, may not be counted toward the limitation imposed by this
   22  subsection.
   23         (2) This section does not supersede any term limit imposed
   24  by a county charter which is more restrictive than the term
   25  limit imposed in this section.
   26         Section 2. Section 1001.35, Florida Statutes, is amended to
   27  read:
   28         1001.35 Term of office.—District school board members shall
   29  be elected at the general election in November for terms of 4
   30  years, except that a person may not appear on the ballot for
   31  reelection to the office of school board member if, by the end
   32  of his or her current term of office, the person will have
   33  served, or but for resignation would have served, in that office
   34  for 8 12 consecutive years. Service of a term of office which
   35  commenced before November 8, 2022, will not be counted toward
   36  the limitation imposed by this section.
   37         Section 3. This act shall take effect July 1, 2023.
