The Committee on Criminal Justice (Avila) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 17 - 29
4 and insert:
5 (1) As used in this section, the term:
6 (a) “First responder” includes a law enforcement officer as
7 defined in s. 943.10(1), a firefighter as defined in s. 784.07,
8 and an emergency medical care provider as defined in s. 784.07.
9 (b) “Harass” means to engage in a course of conduct
10 directed at a first responder which causes substantial emotional
11 distress in that first responder and serves no legitimate
12 purpose.
13 (2)(a) It is unlawful for a person, after receiving a
14 warning not to approach from a first responder who is engaged
15 in the lawful performance of a legal duty, to violate such
16 warning and approach or remain within 20 feet of the first
17 responder with the intent to:
18 1. Interrupt, disrupt, hinder, impede, or interfere with
19 the first responder’s ability to perform such duty;
20 2. Threaten the first responder with physical harm;
21 3. Harass the first responder or

25 And the title is amended as follows:
26 Delete lines 2 - 8
27 and insert:
28 An act relating to impeding, threatening, or harassing
29 first responders; creating s. 843.31, F.S.; defining
30 the terms “first responder” and “harass”; prohibiting
31 a person, after receiving a warning not to approach
32 from a first responder who is engaged in the lawful
33 performance of a legal duty, to violate such warning
34 and approach or remain within 20 feet of the first
35 responder with specified intent; providing criminal
36 penalties; providing an
