House Comm: RCS . 04/04/2023 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Boyd) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 18 - 28 4 and insert: 5 559.956 Registrations and transfers of heating, 6 ventilation, and air-conditioning system manufacturer 7 warranties; required contractor documentation.— 8 (1) If a residential real property that includes a heating, 9 ventilation, and air-conditioning (HVAC) system as a fixture to 10 the property is conveyed to a new owner, a manufacturer’s 11 warranty in effect on that system or a component of that system: 12 (a) Is automatically transferred to the new owner; and 13 (b) Continues in effect as if the new owner was the 14 original purchaser of such system or component, as applicable. 15 (2) A warrantor continues to be obligated under the terms 16 of a manufacturer’s warranty agreement for a warranty 17 transferred under this section and may not charge a fee for the 18 transfer of the warranty. 19 (3) The transfer of a manufacturer’s warranty under this 20 section does not extend the remaining term of the warranty. 21 (4) A manufacturer’s warranty for an HVAC system is deemed 22 registered with the manufacturer if a contractor licensed under 23 part I of chapter 489: 24 (a) Installs the new HVAC system; and 25 (b) Provides the manufacturer of the HVAC system with the 26 date of the issuance of the certificate of occupancy for 27 installations relating to new construction, or the serial number 28 of the HVAC system for installations relating to existing 29 construction, as applicable. 30 (5) A contractor licensed under part I of chapter 489 who 31 installs a new HVAC system must document the installation 32 through an invoice or a receipt and provide the 33 34 ================= T I T L E A M E N D M E N T ================ 35 And the title is amended as follows: 36 Delete lines 5 - 10 37 and insert: 38 specifying that certain warranties for heating, 39 ventilation, and air-conditioning (HVAC) systems are 40 automatically transferred and remain in effect under 41 certain circumstances relating to the conveyance of 42 property; specifying that a warrantor continues to be 43 obligated under the terms of such transferred 44 warranty; prohibiting warrantors from charging a fee 45 for such transfers; specifying that such transfers do 46 not extend the remaining term of a warranty; deeming 47 manufacturers’ warranties for HVAC systems registered 48 with the manufacturer if certain requirements are met; 49 requiring certain contractors installing HVAC
