Florida Senate - 2023 SB 1242 By Senator Boyd 20-01102-23 20231242__ 1 A bill to be entitled 2 An act relating to registrations and transfers of 3 heating, ventilation, and air-conditioning system 4 manufacturer warranties; creating s. 559.956, F.S.; 5 requiring manufacturer warranties for heating, 6 ventilation, and air-conditioning (HVAC) systems to be 7 registered to the home or building and not to the 8 owner of the home or building; providing for the 9 automatic effectiveness of such warranties at a 10 specified time; requiring contractors installing HVAC 11 systems to provide certain documentation; providing an 12 effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Section 559.956, Florida Statutes, is created to 17 read: 18 559.956 Heating, ventilation, and air-conditioning system 19 manufacturer warranty registrations and transfer; required 20 contractor documentation.—A manufacturer warranty for a heating, 21 ventilation, and air-conditioning (HVAC) system must be 22 registered to the home or building and not to the owner of the 23 home or building. When a new owner takes ownership of the home 24 or building, the current timeframe for the existing manufacturer 25 warranty for the HVAC system stays in place. A manufacturer 26 warranty for an HVAC system automatically becomes effective upon 27 the installation of the HVAC system. A contractor who installs a 28 new HVAC system must document the installation through an 29 invoice or receipt to the customer. 30 Section 2. This act shall take effect July 1, 2023.
