       The Committee on Commerce and Tourism (Gruters) recommended the
       following:
       
    1         Senate Amendment to Amendment (805210) 
    2  
    3         Delete lines 48 - 57
    4  and insert:
    5         (8)(a) A person may not make or knowingly allow to be made
    6  a telephonic sales call to be made if such call involves an
    7  automated system for the selection or dialing of telephone
    8  numbers or the playing of a recorded message when a connection
    9  is completed to a number called without the prior express
   10  written consent of the called party.
   11         (10)
   12         (c) Notwithstanding any other provision of this section, no
   13  action shall lie for a violation of subsection (8) for up to two
   14  communications made within 15 business days after any of the
   15  following:
