The Committee on Ethics and Elections (Ingoglia) recommended the
following:

4 and insert:
5 Section 1. Subsection (23) of section 97.021, Florida
6 Statutes, is amended to read:
7 97.021 Definitions.—For the purposes of this code, except
8 where the context clearly indicates otherwise, the term:
9 (23) “Nonpartisan office” means an office for which a
10 candidate is prohibited from campaigning or qualifying for
11 election or retention in office based on party affiliation.
12 Section 2. Subsections (1) and (3) of section 106.143,
13 Florida Statutes, are amended to read:
14 106.143 Political advertisements circulated prior to
15 election; requirements.—
16 (1)(a) Any political advertisement that is paid for by a
17 candidate running for partisan office, except a write-in
18 candidate, and that is published, displayed, or circulated
19 before, or on the day of, any election must prominently state:
20 1. “Political advertisement paid for and approved by
21 ...(name of candidate)..., ...(party affiliation)..., for
22 ...(office sought)...”; or
23 2. “Paid by ...(name of candidate)..., ...(party
24 affiliation)..., for ...(office sought)....”
25 (b) Any political advertisement that is paid for by a
26 candidate running for nonpartisan office, except a write-in
27 candidate, and that is published, displayed, or circulated
28 before, or on the day of, any election must prominently state:
29 1. “Political advertisement paid for and approved by
30 ...(name of candidate)... for ...(office sought)...”; or
31 2. “Paid by ...(name of candidate)... for ...(office
32 sought)....”
33 (c)(b) Any political advertisement that is paid for by a
34 write-in candidate and that is published, displayed, or
35 circulated before, or on the day of, any election must
36 prominently state:
37 1. “Political advertisement paid for and approved by
38 ...(name of candidate)..., write-in candidate, for ...(office
39 sought)...”; or
40 2. “Paid by ...(name of candidate)..., write-in candidate,
41 for ...(office sought)....”
42 (d)(c) Any other political advertisement published,
43 displayed, or circulated before, or on the day of, any election
44 must prominently:
45 1. Be marked “paid political advertisement” or with the
46 abbreviation “pd. pol. adv.”
47 2. State the name and address of the persons paying for the
48 advertisement.
49 3. State whether the advertisement and the cost of
50 production is paid for or provided in kind by or at the expense
51 of the entity publishing, displaying, broadcasting, or
52 circulating the political advertisement.
53 (e)(d) Any political advertisement made pursuant to s.
54 106.021(3)(d) must prominently state the name and address of the
55 political committee or political party paying for the
56 advertisement.

60 Delete line 3
61 and insert:
62 nonpartisan office; amending s. 97.021, F.S.; revising
63 the definition of the term “nonpartisan office”;
64 amending s. 106.143, F.S.; requiring that a political
65 advertisement paid for by a candidate for nonpartisan
66 office include a certain statement;
