Floor: 1/AD/2R . 03/15/2023 09:04 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Berman moved the following: 1 Senate Amendment 2 3 Delete lines 19 - 40 4 and insert: 5 one dedicated lactation space outside the confines of a restroom 6 for members of the public to express breast milk or breastfeed 7 in private. The space must: 8 (a) Be hygienic, clean and sanitary, and conducive to 9 maintaining and preventing disease; 10 (b) Be shielded from public view; 11 (c) Be free from intrusion while occupied; and 12 (d) Contain an electrical outlet. 13 (2) The person responsible for the operation of the 14 facility housing each district court of appeal may use state 15 appropriated funds or private funding to provide a lactation 16 space as set forth in subsection (1). 17 (3) The requirements of subsection (1) do not apply to a 18 courthouse if the person who is responsible for the operation of 19 the courthouse determines that: 20 (a) New construction would be required to create the 21 lactation space; and 22 (b) The courthouse does not contain a lactation space for 23 employees which may be used by the members of the public and the 24 courthouse does not have: 25 1. A space that could be repurposed as a lactation space 26 open to the public; or 27 2. A space that could be made private at a reasonable cost 28 using portable materials, contingent upon private funding being 29 made available for those costs.
