    1                        A bill to be entitled                      
    2         An act relating to terrorism; amending s. 772.13,
    3         F.S.; specifying that there is no right to a jury
    4         trial under specified provisions and that neither
    5         defendants nor certain persons may use the resources
    6         of the courts of this state in furtherance of a
    7         defense or objection to postjudgment collection
    8         proceedings in any postjudgment execution proceedings
    9         to enforce certain judgments; providing applicability;
   10         providing a directive to the Division of Law Revision;
   11         providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (6) is added to section 772.13,
   16  Florida Statutes, to read:
   17         772.13 Civil remedy for terrorism or facilitating or
   18  furthering terrorism.—
   19         (6)(a)In any postjudgment execution proceedings to enforce
   20  a judgment entered under this section or under 18 U.S.C. s. 2333
   21  or a substantially similar law of the United States or of any
   22  state or territory of the United States:
   23         1.There is no right to a jury trial under s. 56.18 or s.
   24  77.08; and
   25         2.A defendant or a person may not use the resources of the
   26  courts of this state in furtherance of a defense or objection to
   27  postjudgment collection proceedings if the defendant or person
   28  purposely leaves the jurisdiction of this state or the United
   29  States, declines to enter or reenter this state or the United
   30  States to submit to its jurisdiction, or otherwise evades the
   31  jurisdiction of the court in which a criminal case is pending
   32  against the defendant or person. This subparagraph applies to
   33  any entity that is owned or controlled by a person to whom this
   34  paragraph applies.
   35         (b)Paragraph (a) applies to any judgment collectible under
   36  state law and to any civil action pending or filed on or after
   37  the effective date of this act.
   38         Section 2. The Division of Law Revision is directed to
   39  replace the phrase “the effective date of this act” wherever it
   40  appears in this act with the date this act becomes a law.
   41         Section 3. This act shall take effect upon becoming a law.
