1 A bill to be entitled
2 An act relating to fees; amending s. 585.713, F.S.;
3 requiring dog breeders to pay registration and renewal
4 fees in amounts to be determined by the Department of
5 Agriculture and Consumer Services; providing a limit
6 on such fees; requiring the department to notify a
7 certificateholder of the annual renewal fee by a
8 specified date; providing a contingent effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 585.713, as created by SB ___ or similar
13 legislation, is amended to read:
14 585.713 Certificate of registration and inspection; fees.—
15 (1) Each dog breeder with one or more breeding female dogs
16 within this state must apply to the department, on forms
17 supplied by the department, for a certificate of registration.
18 Each application for a certificate of registration must be
19 accompanied by a registration fee in an amount determined by the
20 department.
21 (2) The certificate of registration must be renewed
22 annually on its anniversary date upon satisfactory showing that
23 the applicant has complied with this part and the rules of the
24 department and has paid the annual renewal fee in an amount
25 determined by the department.
26 (3) Neither the certificate of registration fee nor the
27 annual renewal fee may exceed $500.
28 (4)(3) The department shall provide to each dog breeder
29 subject to this section a written notice and renewal form 60
30 days before the annual renewal date, informing the dog breeder
31 of the certificate of registration renewal date and the
32 applicable fee.
33 (5)(4) The department may assess penalties for late filing,
34 not to exceed $500. Upon application before the renewal date,
35 the department may, for good cause, such as natural disasters,
36 hardship cases, or unusual circumstances, supported by written
37 documentation, extend the renewal date without penalty for up to
38 90 days.
39 (6)(5) The department shall issue a certificate of
40 inspection to any dog breeding facility that meets the
41 requirements of this part and the rules of the department.
42 (7)(6) Each dog breeder and dog breeding facility must
43 conspicuously post its certificates of registration and
44 inspection in a place that is in clear and unobstructed public
45 view.
46 (8)(7) A private dog owner may breed one dog, one time for
47 personal benefit and may gift or sell any dog from that litter
48 which he or she chooses not to retain. A private dog owner
49 within the same household who breeds a second litter of dogs
50 must register as a dog breeder pursuant to this part.
51 Section 2. This act shall take effect on the same date that
52 SB ___ or similar legislation takes effect, if such legislation
53 is adopted in the same legislative session or an extension
54 thereof and becomes a law.
