Present subsections (6) through (11) of section 6 465.1895, Florida Statutes, are redesignated as subsections (7) 7 through (12), respectively, a new subsection (6) is added to 8 that section, and subsection (1) and paragraph (b) of subsection 9 (5) of that section are amended, to read: 10 465.1895 Testing or screening for and treatment of minor, 11 nonchronic health conditions.— 12 (1) A pharmacist may test or screen for and treat minor, 13 nonchronic health conditions within the framework of an 14 established written protocol with a supervising physician 15 licensed under chapter 458 or chapter 459 or a standard protocol 16 adopted in rule by the board in consultation with the Board of 17 Medicine and the Board of Osteopathic Medicine. For purposes of 18 this section, a minor, nonchronic health condition is typically 19 a short-term condition that is generally managed with minimal 20 treatment or self-care, and includes: 21 (a) Influenza. 22 (b) Streptococcus. 23 (c) Lice. 24 (d) Skin conditions, such as ringworm and athlete’s foot. 25 (e) Minor, uncomplicated infections. 26 (5) The written protocol between a pharmacist and 27 supervising physician under this subsection must include 28 particular terms and conditions imposed by the supervising 29 physician relating to the testing and screening for and 30 treatment of minor, nonchronic health conditions under this 31 section. The terms and conditions must be appropriate to the 32 pharmacist’s training. A pharmacist who enters into such a 33 protocol with a supervising physician must submit the protocol 34 to the board. 35 (b) A pharmacist authorized to test and screen for and 36 treat minor, nonchronic conditions under a supervising physician 37 protocol shall provide evidence of current certification by the 38 board to the supervising physician. A supervising physician 39 shall review the pharmacist’s actions in accordance with the 40 protocol. 41 (6) In lieu of entering into a protocol with a supervising 42 physician under subsection (5), a pharmacist may test or screen 43 for and treat minor, nonchronic health conditions under a 44 standard protocol adopted in rule by the board in consultation 45 with the Board of Medicine and the Board of Osteopathic 46 Medicine. A pharmacist testing or screening for and treating 47 minor, nonchronic health conditions under the standard protocol 48 must submit a signed copy of the standard protocol to the board. 49 At a minimum, the standard protocol shall include: 50 (a) Specific categories of patients whom the pharmacist is 51 authorized to test or screen for and treat minor, nonchronic 52 health conditions. 53 (b) Instructions for obtaining relevant patient medical 54 history for the purpose of identifying disqualifying health 55 conditions, adverse reactions, and contraindications to the 56 approved course of treatment. 57 (c) Instructions for the treatment of minor, nonchronic 58 health conditions based on the patient’s age, symptoms, and test 59 results, including negative results. 60 (d) Any other requirements as established by the board in 61 consultation with the Board of Medicine and the Board of 62 Osteopathic Medicine. 63 64 ================= T I T L E A M E N D M E N T ================ 65 And the title is amended as follows: 66 Delete line 72 67 and insert: 68 examination; amending s. 465.1895, F.S.; authorizing 69 pharmacists to test or screen for and treat minor, 70 nonchronic health conditions under a standard protocol 71 adopted by the Board of Pharmacy in consultation with 72 the Board of Medicine and the Board of Osteopathic 73 Medicine, in lieu of entering into a protocol with a 74 supervising physician; requiring such pharmacists to 75 submit a signed copy of the standard protocol to the 76 board; providing minimum requirements for the standard 77 protocol; amending s. 468.1115, F.S.; providing
