House Comm: RCS . 04/24/2023 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Rules (Wright) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 127 - 144 4 and insert: 5 (a) The state land planning agency may recommend to the 6 Administration Commission the removal of the designation of the 7 Brevard Barrier Island Area as an area of critical state concern 8 if the agency determines that all local land development 9 regulations and local comprehensive plans and the administration 10 of such regulations and plans are adequate to protect the 11 Brevard Barrier Island Area, continue to carry out the 12 legislative intent expressed in subsection (3), and are in 13 compliance with the principles for guiding development specified 14 in subsection (5). If the commission concurs with the 15 recommendation to remove the designation, it must, within 45 16 days after receipt of the recommendation, initiate rulemaking to 17 remove the designation. 18 (b) Beginning November 30, 2030, the state land planning 19 agency shall annually submit a written report to the 20 Administration Commission describing the progress of the Brevard 21 Barrier Island Area toward implementing the guiding principles 22 for development specified in subsection (5) and achieving the 23 legislative intent expressed in subsection (3). The agency shall 24 recommend removing the designation of the Brevard Barrier Island 25 Area as an area of critical state concern to the commission if 26 it determines that: 27 1. Adequate restoration and renourishment programs are in 28 place to preserve the beaches and dunes of the southern barrier 29 island in Brevard County for nesting sea turtles; 30 2. Seagrass replanting in the Indian River Lagoon extending 31 the length of the Brevard Barrier Island Area is in a 32 33 ================= T I T L E A M E N D M E N T ================ 34 And the title is amended as follows: 35 Delete line 9 36 and insert: 37 the designation upon the recommendation of the state 38 land planning agency; requiring the Administration 39 Commission to initiate rulemaking within a specified 40 timeframe under certain circumstances; requiring the 41 state land planning agency to submit an annual report 42 to the commission; providing requirements for the 43 report; providing an effective date.
