Florida Senate - 2023 SB 1704 By Senator DiCeglie 18-01107-23 20231704__ 1 A bill to be entitled 2 An act relating to commercial motor vehicle insurance; 3 amending s. 627.7415, F.S.; requiring specified 4 combined bodily and property damage liability 5 insurance coverage for commercial motor vehicles used 6 to furnish equipment, supplies, materials, or services 7 to certain projects for a governmental entity; 8 providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 627.7415, Florida Statutes, is amended 13 to read: 14 627.7415 Commercial motor vehicles; additional liability 15 insurance coverage.—Commercial motor vehicles, as defined in s. 16 207.002 or s. 320.01, operated upon the roads and highways of 17 this state shall be insured with the following minimum levels of 18 combined bodily liability insurance and property damage 19 liability insurance in addition to any other insurance 20 requirements: 21 (1) Fifty thousand dollars per occurrence for a commercial 22 motor vehicle with a gross vehicle weight of 26,000 pounds or 23 more, but less than 35,000 pounds. 24 (2) One hundred thousand dollars per occurrence for a 25 commercial motor vehicle with a gross vehicle weight of 35,000 26 pounds or more, but less than 44,000 pounds. 27 (3) Three hundred thousand dollars per occurrence for a 28 commercial motor vehicle with a gross vehicle weight of 44,000 29 pounds or more. 30 (4) All commercial motor vehicles subject to regulations of 31 the United States Department of Transportation, 49 C.F.R. part 32 387, subparts A and B, and as may be hereinafter amended, shall 33 be insured in an amount equivalent to the minimum levels of 34 financial responsibility as set forth in such regulations. 35 (5) Notwithstanding subsections (1) through (4), $1 million 36 per occurrence for any commercial motor vehicle used to furnish 37 equipment, supplies, materials, or services to a project for a 38 governmental entity which involves construction or maintenance 39 of a transportation facility bridge, road, street, highway, or 40 railroad, and services incidental thereto. 41 42 A violation of this section is a noncriminal traffic infraction, 43 punishable as a nonmoving violation as provided in chapter 318. 44 Section 2. This act shall take effect July 1, 2023.
