       Senator Jones moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 1167 - 1170
    4  and insert:
    5  solely because of the issuance of a valid immigration detainer
    6  or warrant may submit a DNA sample when the law enforcement
    7  agency receives the detainer or warrant; however, a law
    8  enforcement agency may not forcibly extract a DNA sample from
    9  such a person, and he or she may not be charged with a criminal
   10  offense for refusing to submit a DNA sample.

   13  And the title is amended as follows:
   14         Delete lines 160 - 162
   15  and insert:
   16         issued by a federal immigration agency; providing that
   17         certain qualifying offenders may submit DNA samples at
   18         a specified time; prohibiting law enforcement agencies
   19         from forcibly extracting a DNA sample from such
   20         persons; providing that such a person who refuses to
   21         submit a DNA sample may not be charged with a criminal
   22         offense for refusing to submit a DNA sample; requiring
   23         law enforcement agencies
