Floor: 1/F/2R . 04/27/2023 11:51 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Berman moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 256 - 262 4 and insert: 5 voluntary inquiry on its patient admission or registration forms 6 for the patient or the patient’s representative to state or 7 indicate whether the patient is a United States citizen or 8 whether the patient is lawfully present in the United States or 9 is not lawfully present in the United States. The patient or the 10 patient’s representative must be informed that answering this 11 question is optional, both in writing accompanying the question 12 on the registration form and verbally by a hospital 13 representative in a language understood by the patient or the 14 patient’s representative. The voluntary inquiry must be followed 15 by both written and verbal statements in a language understood 16 by the patient or the patient’s representative that the response 17 will not affect the patient’s care or result in a report of the 18 patient’s immigration status to immigration authorities. 19 Hospital representatives need not inquire into a patient’s 20 immigration status if doing so would be contrary to the American 21 Medical Association’s Code of Medical Ethics. 22 23 ================= T I T L E A M E N D M E N T ================ 24 And the title is amended as follows: 25 Delete line 21 26 and insert: 27 include a voluntary inquiry into the patient’s 28 immigration status on
