House Comm: RCS . 04/04/2023 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Bradley) recommended the following: 1 Senate Amendment 2 3 Delete lines 92 - 108 4 and insert: 5 communicate with a social media platform to request the social 6 media platform to remove content or accounts from the social 7 media platform. 8 (3) A governmental entity, or an officer or a salaried 9 employee acting on behalf of a governmental entity, may not 10 initiate or maintain any agreements or working relationships 11 with a social media platform for the purpose of content 12 moderation. 13 (4) Subsections (2) and (3) do not apply if the 14 governmental entity or an officer or a salaried employee acting 15 on behalf of a governmental entity is acting as part of any of 16 the following: 17 (a) Routine account management of the governmental entity’s 18 account. 19 (b) An attempt to remove content that pertains to the 20 commission of a crime or violation of this state’s public 21 records law. 22 (c) An attempt to remove an account that pertains to the 23 commission of a crime or violation of this state’s public 24 records law. 25 (d) An investigation or inquiry related to public safety.
