House Comm: RCS . 03/29/2023 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Judiciary (Rodriguez) recommended the following: 1 Senate Amendment 2 3 Delete lines 24 - 43 4 and insert: 5 6 brought within 2 years after the date that the alleged act or 7 omission is discovered, or should have been discovered, but in 8 no case shall such action be brought more than 4 years after the 9 date the appraisal services or appraisal management services 10 were performed, or should have been performed. 11 (3) Notwithstanding any other law to the contrary, all 12 actions for damages or other relief brought against an appraiser 13 or appraisal management company with respect to appraisal 14 services or appraisal management services shall be governed 15 exclusively by the provisions of this section. 16 (4) This section does not apply to any administrative 17 proceedings initiated by the board or department. 18 (5) This section does not apply to any action founded upon 19 fraud in the provision of appraisal services or appraisal 20 management services by an appraiser or appraisal management 21 company. 22 Section 2. Section 95.371, Florida Statutes, applies to any 23 action accruing on or after July 1, 2023. Any action accruing 24 before July 1, 2023, which would not have been barred before 25 July 1, 2023, must be commenced by July 1, 2024. Any such action 26 that is not commenced by July 1, 2024, is barred by this act.
