Senator Ingoglia moved the following:

4 insert:
5 Section 1. Subsection (3) of section 124.01, Florida
6 Statutes, is amended to read:
7 124.01 Division of counties into districts; county
8 commissioners.—
9 (3) The board of county commissioners shall, from time to
10 time, fix the boundaries of the county commissioners’ above
11 districts so as to keep them as nearly equal in proportion to
12 population as practicable, possible; provided, that changes made
13 in the boundaries of county commissioner districts pursuant to
14 this section may not shall be made only in the 270 days before a
15 regular general election for the board of county commissioners
16 odd-numbered years. Districts may not be drawn with the intent
17 to favor or disfavor a candidate for county commission or an
18 incumbent county commissioner based on the candidate’s or
19 incumbent’s residential address. Any ordinance enacted or
20 adopted by a county on or after July 1, 2023, which is in
21 conflict with this subsection is void.
22 Section 2. Section 166.0321, Florida Statutes, is created
23 to read:
24 166.0321 Division of municipalities into districts.—Each
25 municipality shall, from time to time, fix the boundaries of its
26 districts so as to keep them as nearly equal in proportion to
27 their respective populations as practicable, provided that such
28 changes may not be made in the 270 days before a regular general
29 election for the governing body of the municipality. Districts
30 may not be drawn with the intent to favor or disfavor a
31 candidate for member of the governing body or an incumbent
32 member of the governing body based on the candidate’s or
33 incumbent’s residential address. Any ordinance enacted or
34 adopted by a municipality on or after July 1, 2023, which is in
35 conflict with this section is void.
36 Section 3. Subsection (2) of section 1001.36, Florida
37 Statutes, is amended to read:
38 1001.36 District school board member residence areas.—
39 (2) A Any district school board may make any change that it
40 deems necessary in the boundaries of any district school board
41 member residence area at any meeting of the district school
42 board, provided that such changes are not shall be made only in
43 the 270 days before a general election odd-numbered years and
44 that no change that would affect the residence qualifications of
45 any incumbent member disqualifies shall disqualify such
46 incumbent member during the term for which he or she is elected.
47 Residence areas may not be drawn with the intent to favor or
48 disfavor a candidate for district school board member or an
49 incumbent district school board member based on the candidate’s
50 or incumbent’s residential address. Any resolution adopted by a
51 district school board on or after July 1, 2023, which is in
52 conflict with this subsection is void.
