The Committee on Criminal Justice (Davis) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Subsection (14) of section 775.15, Florida
6 Statutes, is amended to read:
7 775.15 Time limitations; general time limitations;
8 exceptions.—
9 (14)(a) A prosecution for a first or second degree felony
10 violation of s. 794.011, if the victim is 16 years of age or
11 older at the time of the offense and the offense is reported to
12 a law enforcement agency within 72 hours after commission of the
13 offense, may be commenced at any time.
14 (b) A prosecution for a first or second degree felony
15 violation of s. 794.011, if the victim is 18 years of age or
16 older at the time of the offense and the offense is reported to
17 a law enforcement agency or a person acting within the scope of
18 his or her practice who is licensed under chapter 458, chapter
19 459, chapter 490, or chapter 491 within 21 days after commission
20 of the offense, may be commenced at any time. This paragraph
21 applies to an offense that is committed on or after July 1,
22 2023.
23 (c)(b) Except as provided in paragraph (a), or paragraph
24 (13)(b), or subsection (20), a prosecution for a first or second
25 degree felony violation of s. 794.011, if the victim is 16 years
26 of age or older at the time of the offense, must be commenced
27 within 8 years after the violation is committed. This paragraph
28 applies to any such offense except an offense the prosecution of
29 which would have been barred by subsection (2) on or before July
30 1, 2015.
31 Section 2. This act shall take effect July 1, 2023.

37 A bill to be entitled
38 An act relating to time limitations for prosecution of
39 certain sexual battery offenses; amending s. 775.15,
40 F.S.; revising the time limitations for prosecution of
41 specified sexual battery offenses committed on victims
42 18 years of age or older in certain circumstances;
43 providing applicability; providing an effective date.
