    1                        A bill to be entitled                      
    2         An act relating to private instructional personnel;
    3         amending s. 1003.572, F.S.; revising the definition of
    4         the term “private instructional personnel” to include
    5         registered behavioral technicians employed by certain
    6         providers; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Paragraph (b) of subsection (1) of section
   11  1003.572, Florida Statutes, is amended to read:
   12         1003.572 Collaboration of public and private instructional
   13  personnel.—
   14         (1) As used in this section, the term “private
   15  instructional personnel” means:
   16         (b) Registered behavior technicians who have a nationally
   17  recognized paraprofessional certification in behavior analysis
   18  and who practice under the supervision of individuals described
   19  in paragraph (a) by assisting and supporting such individuals in
   20  the provision of applied behavior analysis services. To provide
   21  services under this section, a registered behavior technician
   22  must be employed by a provider described in paragraph (a) an
   23  enrolled Medicaid provider.
   24         Section 2. This act shall take effect July 1, 2023.
