       Senator Polsky moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 490 - 503
    4  and insert:
    5         (2)A person who is not licensed under s. 790.06 but is
    6  otherwise authorized under this section to carry a concealed
    7  weapon or concealed firearm is limited to carrying one concealed
    8  firearm on or about his or her person at a time. Such concealed
    9  firearm may not have a magazine capacity exceeding 16 rounds.
   10         (3)(1) Except as provided in subsection (7) (3), a person
   11  who does not meet the criteria in subsection (1) is not licensed
   12  under s. 790.06 and who carries a concealed weapon or electric
   13  weapon or device, as those terms are defined in s. 790.001, on
   14  or about his or her person commits a misdemeanor of the first
   15  degree, punishable as provided in s. 775.082 or s. 775.083.
   16         (4)(2) Except as provided in subsection (7) (3), a person
   17  who does not meet the criteria in subsection (1) is not licensed
   18  under s. 790.06 and who carries a concealed firearm, as that
   19  term is defined in s. 790.001, on or about his or her person
   20  commits a felony of the third degree, punishable as provided in
   21  s. 775.082, s. 775.083, or s. 775.084.
   22         (5)Except as provided in subsection (7), a person who
   23  carries a concealed firearm, as defined in s. 790.001, on or
   24  about his or her person in violation of subsection (2) by either
   25  carrying more than one concealed firearm on or about his or her
   26  person or by carrying a firearm with a magazine capacity
   27  exceeding 16 rounds commits a felony of the third degree,
   28  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
   29         (6)In any prosecution for a violation of subsection (3) or
   30  subsection (4), the state bears the burden of proving, as an
   31
