    1                        A bill to be entitled                      
    2         An act relating to the termination of agreements by a
    3         servicemember; amending ss. 83.682 and 689.27, F.S.;
    4         defining the term “government quarters” for purposes
    5         of the termination of a servicemember’s rental
    6         agreement or agreement to purchase real property,
    7         respectively; making technical changes; providing an
    8         effective date.
    9          
   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (1) of section 83.682, Florida
   13  Statutes, is amended to read:
   14         83.682 Termination of rental agreement by a servicemember.—
   15         (1) Any servicemember may terminate his or her rental
   16  agreement by providing the landlord with a written notice of
   17  termination to be effective on the date stated in the notice
   18  which that is at least 30 days after the landlord’s receipt of
   19  the notice if any of the following criteria are met:
   20         (a) The servicemember is required, pursuant to a permanent
   21  change of station orders, to move 35 miles or more from the
   22  location of the rental premises;
   23         (b) The servicemember is prematurely or involuntarily
   24  discharged or released from active duty or state active duty;
   25         (c) The servicemember is released from active duty or state
   26  active duty after having leased the rental premises while on
   27  active duty or state active duty status and the rental premises
   28  is 35 miles or more from the servicemember’s home of record
   29  before prior to entering active duty or state active duty;
   30         (d) After entering into a rental agreement, the
   31  servicemember receives military orders requiring him or her to
   32  move into government quarters or the servicemember becomes
   33  eligible to live in and opts to move into government quarters.
   34  For purposes of this paragraph, the term “government quarters”
   35  means any military housing option that is available to a
   36  servicemember, including privatized military installation
   37  housing that is owned by a private sector company;
   38         (e) The servicemember receives temporary duty orders,
   39  temporary change of station orders, or state active duty orders
   40  to an area 35 miles or more from the location of the rental
   41  premises, provided such orders are for a period exceeding 60
   42  days; or
   43         (f) The servicemember has leased the property, but before
   44  prior to taking possession of the rental premises, receives a
   45  change of orders to an area that is 35 miles or more from the
   46  location of the rental premises.
   47         Section 2. Paragraphs (c) and (d) of subsection (1) of
   48  section 689.27, Florida Statutes, are redesignated as paragraphs
   49  (d) and (e), respectively, and a new paragraph (c) is added to
   50  that subsection, to read:
   51         689.27 Termination by servicemember of agreement to
   52  purchase real property.—
   53         (1) Notwithstanding any other provisions of law and for the
   54  purposes of this section:
   55         (c)“Government quarters” means any military housing option
   56  that is available to a servicemember, including privatized
   57  military installation housing that is owned by a private sector
   58  company.
   59         Section 3. This act shall take effect July 1, 2023.
