6 enterprises; providing state university
7 responsibilities relating to auxiliary enterprises;
8 requiring the Board of Governors to adopt regulations;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 1011.47, Florida Statutes, is amended to
14 read:
15 1011.47 Auxiliary enterprises; contracts, grants, and
16 donations; reporting requirements.—
17 (1) As used in s. 19(f)(3), Art. III of the State
18 Constitution, the term:
19 (a)(1) “Auxiliary enterprises” includes activities that
20 directly or indirectly provide a product or a service, or both,
21 to a university or its students, faculty, or staff and for which
22 a charge is made. These auxiliary enterprises are business
23 activities of a university which require no support from the
24 General Revenue Fund, and include activities such as housing,
25 bookstores, student health services, continuing education
26 programs, food services, college stores, operation of vending
27 machines, specialty shops, day care centers, golf courses,
28 student activities programs, data center operations, and
29 intercollegiate athletics programs.
30 (b)(2) “Contracts, grants, and donations” includes
31 noneducational and general funding sources in support of
32 research, public services, and training. The term includes
33 grants and donations, sponsored-research contracts, and
34 Department of Education funding for lab schools and other
35 activities for which the funds are deposited outside the State
36 Treasury.
37 (2)(a) The Board of Governors shall establish uniform
38 reporting requirements for auxiliary enterprises of state
39 universities. Each state university shall determine if its
40 auxiliary enterprises, including intercollegiate athletics
41 programs, shall be self-supporting on an individual or
42 collective basis.
43 (b) The Board of Governors shall adopt regulations to
44 administer this subsection.
45 Section 2. This act shall take effect July 1, 2023.
