    1                        A bill to be entitled                      
    2         An act relating to public lodging establishments;
    3         amending s. 509.096, F.S.; prohibiting the Division of
    4         Hotels and Restaurants of the Department of Business
    5         and Professional Regulation from providing a
    6         correction period to public lodging establishments for
    7         a second or subsequent violation for failure to comply
    8         with certain requirements; requiring the division to
    9         impose the administrative fine for a second or
   10         subsequent violation; providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (3) of section 509.096, Florida
   15  Statutes, is amended to read:
   16         509.096 Human trafficking awareness training and policies
   17  for employees of public lodging establishments; enforcement.—
   18         (3) The division shall impose an administrative fine of
   19  $2,000 per day on a public lodging establishment that is not in
   20  compliance with this section and remit the fines to the direct
   21  support organization established under s. 16.618, unless the
   22  division receives adequate written documentation from the public
   23  lodging establishment which provides assurance that each
   24  deficiency will be corrected within 90 days after the division
   25  provided the public lodging establishment with notice of its
   26  violation for the first violation. The division may not provide
   27  a correction period to a public lodging establishment that
   28  violates this subsection for a second or subsequent time. The
   29  division shall impose the administrative fine under this
   30  subsection for a second or subsequent violation of this section.
   31         Section 2. This act shall take effect July 1, 2023.
