Florida Senate - 2023 (PROPOSED BILL) SPB 7030 FOR CONSIDERATION By the Appropriations Committee on Health and Human Services 603-02490A-23 20237030pb 1 A bill to be entitled 2 An act relating to trust funds; amending s. 20.195, 3 F.S.; creating the State Opioid Settlement Trust Fund 4 within the Department of Children and Families; 5 providing the purpose of the trust fund; specifying 6 the funding source for the trust fund; providing for 7 the reversion of certain funds to the Department of 8 Financial Services Opioid Settlement Clearing Trust 9 Fund; providing for future review and termination or 10 re-creation of the trust fund; providing an effective 11 date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsection (11) is added to section 20.195, 16 Florida Statutes, to read: 17 20.195 Department of Children and Families; trust funds. 18 The following trust funds shall be administered by the 19 Department of Children and Families: 20 (11) State Opioid Settlement Trust Fund.— 21 (a) The State Opioid Settlement Trust Fund is created 22 within the Department of Children and Families. The purpose of 23 the trust fund is to abate the opioid epidemic in accordance 24 with the settlement agreements reached by the state in opioid 25 related litigation or bankruptcy proceedings. 26 (b) The Department of Financial Services shall annually 27 transfer, by nonoperating transfer, the amount specified in the 28 General Appropriations Act from its Opioid Settlement Clearing 29 Trust Fund to the department’s State Opioid Settlement Trust 30 Fund. 31 (c) Notwithstanding s. 216.301 and pursuant to s. 216.351, 32 any unencumbered balance in the trust fund at the end of any 33 fiscal year and any encumbered balance remaining undisbursed on 34 September 30 of the same calendar year shall revert to the 35 Department of Financial Services Opioid Settlement Clearing 36 Trust Fund. 37 (d) In accordance with s. 19(f)(2), Art. III of the State 38 Constitution, the State Opioid Settlement Trust Fund, unless 39 terminated sooner, shall be terminated on July 1, 2027. Before 40 its scheduled termination, the trust fund shall be reviewed as 41 provided in s. 215.3206(1) and (2). 42 Section 2. This act shall take effect July 1, 2023.
