       Senator Davis moved the following:
       
    1         Senate Amendment to Amendment (333316) (with title
    2  amendment)
    3  
    4         Between lines 2144 and 2145
    5  insert:
    6         Section 40. Subsection (4) is added to section 104.011,
    7  Florida Statutes, to read:
    8         104.011 False swearing; submission of false voter
    9  registration information; prosecution prohibited.—
   10         (4)Subsection (1) does not apply to an elector to whom
   11  notice has been sent pursuant to s. 98.075(7) and who votes
   12  using a provisional ballot or vote-by-mail ballot before a final
   13  determination of eligibility is made.
   14         Section 41. Section 104.15, Florida Statutes, is amended to
   15  read:
   16         104.15 Unqualified electors willfully voting.—
   17         (1) Whoever, knowing he or she is not a qualified elector,
   18  willfully votes at any election is guilty of a felony of the
   19  third degree, punishable as provided in s. 775.082, s. 775.083,
   20  or s. 775.084.
   21         (2)Subsection (1) does not apply to an elector to whom
   22  notice has been sent pursuant to s. 98.075(7) and who votes
   23  using a provisional ballot or vote-by-mail ballot before a final
   24  determination of eligibility is made.
