       Senator Harrell moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 685 - 688
    4  and insert:
    5         (5) Any claims or causes of action brought against a
    6  sheriff under state or federal law relating to the sheriff’s
    7  provision of child protective investigative services filed:
    8         (a) Before the applicable transfer date must be defended
    9  and indemnified in accordance with the provisions of the state
   10  or grant agreement applicable at the time of the alleged
   11  incident.
   12         (b) After the applicable transfer date must be defended and
   13  indemnified by the department.
   14  
   15  This subsection may not be construed as a waiver of s. 768.28,
   16  Florida Statutes.
