    1                        A bill to be entitled                      
    2         An act relating to temporary commercial kitchens;
    3         amending s. 509.101, F.S.; defining the term
    4         “temporary commercial kitchen”; authorizing the
    5         Division of Hotels and Restaurants of the Department
    6         of Business and Professional Regulation to adopt by
    7         rule operational requirements for temporary commercial
    8         kitchens; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (4) is added to section 509.101,
   13  Florida Statutes, to read:
   14         509.101 Establishment rules; posting of notice; food
   15  service inspection report; maintenance of guest register; mobile
   16  food dispensing vehicle registry.—
   17         (4)(a)For purposes of this subsection, “temporary
   18  commercial kitchen” means a food preparation and cooking
   19  facility set up for the preparation of takeout or delivery-only
   20  meals housed in portable structures that are movable from place
   21  to place by a tow or are self-propelled or otherwise axle
   22  mounted. The term does not include a tent or shed.
   23         (b)The division shall establish rules for the operation of
   24  temporary commercial kitchens. Such rules must require temporary
   25  commercial kitchens to:
   26         1.Be climate-controlled.
   27         2.Maintain a humidity factor of less than 60 percent in
   28  the space of the unit.
   29         3.Have a total gross weight not exceeding 5,000 pounds.
   30         4.Maintain ADA compliant entrances and access windows.
   31         5.Maintain a sink in compliance with Department of
   32  Business and Professional Regulation standards.
   33         6.Maintain either internal or external fresh water supply
   34  and graywater disposal.
   35         7.Maintain electrical, plumbing, and mechanical
   36  specifications that meet or exceed national agency standards or
   37  best industry standards.
   38         8.Maintain a wind rating greater than 70 mph.
   39         Section 2. This act shall take effect July 1, 2023.
