House Comm: RCS . 03/20/2023 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Criminal Justice (Simon) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete everything after the enacting clause 4 and insert: 5 Section 1. Section 871.05, Florida Statutes, is created to 6 read: 7 871.05 Interference with a sporting or entertainment 8 event.— 9 (1) As used in this section, the term: 10 (a) “Covered event” means an athletic competition or 11 practice, including one conducted in a public venue or a live 12 artistic, theatrical, or other entertainment performance event. 13 The duration of such event includes the period from the time 14 when a venue is held open to the public for such an event until 15 the end of the athletic competition or performance event. 16 (b) “Covered participant” means an umpire, officiating crew 17 member, player, coach, manager, groundskeeper, or any artistic, 18 theatrical, or other performer or sanctioned participant in a 19 covered event. The term includes event operations and security 20 employees working at a covered event. 21 (c) “Restricted area” means any area designated for use by 22 players, coaches, officials, performers, or other personnel 23 administering a covered event that is on, or adjacent to, the 24 area of play or performance. 25 (2) A person may not: 26 (a) Intentionally touch or strike a covered participant 27 during a covered event against the will of the covered 28 participant, or intentionally cause bodily harm to a covered 29 participant during a covered event; or 30 (b) Willfully enter or remain in a restricted area during a 31 covered event without being authorized, licensed, or invited to 32 enter or remain in such a restricted area. 33 (3) A person who: 34 (a) Violates subsection (2) commits a misdemeanor of the 35 first degree, punishable as provided in s. 775.082 or by a fine 36 of not more than $2,500. 37 (b) Solicits another person to violate subsection (2) by 38 offering money or any other thing of value to another to engage 39 in specific conduct that constitutes such a violation commits a 40 felony of the third degree, punishable as provided in s. 41 775.082, s. 775.083, or s. 775.084. 42 (4) A person convicted of a violation of this section may 43 not realize any profit or benefit, directly or indirectly, from 44 committing such a violation. Any profit or benefit payable to or 45 accruing to a person convicted of a violation of this section is 46 subject to seizure and forfeiture as provided in the Florida 47 Contraband Forfeiture Act. 48 Section 2. This act shall take effect October 1, 2023. 49 50 ================= T I T L E A M E N D M E N T ================ 51 And the title is amended as follows: 52 Delete everything before the enacting clause 53 and insert: 54 A bill to be entitled 55 An act relating to interference with sporting or 56 entertainment events; creating s. 871.05, F.S.; 57 providing definitions; prohibiting certain actions 58 during covered sporting and entertainment events; 59 providing criminal penalties; prohibiting profiting 60 from violations; providing for seizure and forfeiture 61 of specified assets; providing an effective date.
