       The Committee on Criminal Justice (Burgess) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 30 - 52
    4  and insert:
    5  related disorder, or Down syndrome, may be enrolled in the
    6  registry.
    7         (b) An adult with a disability may enroll himself or
    8  herself in the registry. If a person with a disability has been
    9  declared incapacitated under chapter 744, a parent or legal
   10  guardian of the person may enroll him or her in the registry. An
   11  incapacitated adult enrolled by another person must be notified
   12  of that enrollment by the local law enforcement agency in
   13  writing at his or her address of record within 5 business days
   14  after enrollment in the registry.
   15         (c) A minor with a disability or condition may be enrolled
   16  in the registry by his or her parent or legal guardian. A minor
   17  who was enrolled by another person must be notified by the
   18  agency in writing of that enrollment at his or her address of
   19  record within 5 business days after his or her 18th birthday.
   20         (d) At the time of registration, proof of eligibility for
   21  enrollment in the registry must be submitted to the local law
   22  enforcement agency. The local law enforcement agency may accept
   23  any of the following documents for the requisite proof of
   24  eligibility:
   25         1. Certification of the disability or condition from a:
   26         a. Physician or physician assistant licensed under chapter
   27  458 or chapter 459 or an advanced practice registered nurse
   28  licensed under chapter 464; or
   29         b. Psychologist licensed under chapter 490, a mental health
   30  counselor licensed under chapter 491, or a psychiatrist as
   31  defined in s. 394.455(37) if the registration is based on
   32  psychological conditions.
   33         2. Documentation of the legal authority for a parent or
   34  legal guardian to enroll a child or ward, which may include, but
   35  need not be limited to, proof of parentage or guardianship, as
   36  applicable:
   37         a. A birth certificate as described in s. 382.013;
   38         b. A power of attorney, as defined in s. 709.2102(9);
   39         c. A court order establishing parental rights or
   40  guardianship; or
   41         d.Letters of guardianship as described in s. 744.345.
   42         (e) A registration is valid until the person is removed

   45  And the title is amended as follows:
   46         Between lines 7 and 8
   47  insert:
   48         requiring certain documentation to be submitted;
   49         requiring proof of legal authority from a parent or
   50         guardian enrolling a child or ward in the registry;
